1. General Provisions

Use of the platform naftalan.health is governed by this document — Terms and Conditions of Use (hereinafter the "Agreement"). Please read these Terms carefully before using naftalan.health. By accessing or using the services of naftalan.health, you confirm that you have read, understood, and fully accepted this Agreement.

This Agreement establishes the legally binding conditions for use of naftalan.health services. By using the platform, you accept these Terms whether you are a "Visitor" (a person browsing the platform without making a booking) or a "Client" (a person who has paid the service fee and entered into a Service Agreement with Alexandr Umanet). The term "User" designates both categories.

You may use naftalan.health only if you agree to comply with this Agreement and all applicable laws of the European Union, including where you are resident in Israel or Turkey.

The content of naftalan.health — including texts, visuals, platform architecture, and all information provided — is the property of or licensed to Alexandr Umanet. The Operator may periodically update this Agreement; changes take effect upon publication at naftalan.health. Continued use of the platform after publication constitutes acceptance of the revised terms.

2. Privacy Policy

Use of naftalan.health is also governed by the Privacy Policy of the Operator, available at: naftalan.health/privacy-policy, incorporated by reference into these Terms. We recommend reading it in full before using the platform's services.

3. Description of Services

Alexandr Umanet, operating under the brand naftalan.health, provides independent travel coordination and medical orientation services for individuals seeking Naftalan oil therapy treatment at sanatoriums in Naftalan, Republic of Azerbaijan. The Operator acts exclusively as an independent coordinator and intermediary — not as a sanatorium, medical provider, travel agency, or tour operator.

The Naftalan Health Navigator service package, provided for a flat fee of €150 (one hundred and fifty euros), includes the following:

  • Personalised medical orientation consultation: assessment of the client's health profile and suitability for Naftalan oil therapy, with a recommendation of the most appropriate sanatorium and treatment programme;

  • Flight optimisation: identification and recommendation of the most suitable flights to/from Baku or Ganja, Azerbaijan, based on the client's travel dates and preferences;

  • Visa assistance: guidance on entry requirements and visa procedures for Azerbaijan applicable to the client's nationality;

  • One included excursion: coordination of one excursion during the client's stay in Naftalan or surroundings;

  • 24/7 on-the-ground support: availability by phone and messaging throughout the client's stay in Azerbaijan.

The following are not included in the €150 fee and are paid directly by the client to the respective providers:

  • Sanatorium accommodation and medical treatment costs;

  • Flight tickets;

  • Airport-to-sanatorium transfers;

  • Travel medical insurance;

  • Any excursions beyond the one included;

  • Personal expenses.

The exact scope, sanatorium recommendation, and trip details are confirmed in a separate Service Agreement sent to the client by email within 24 hours of payment.

4. Booking and Payment Process

4.1. Initiating the Service

To engage the Naftalan Health Navigator service, the User completes the booking form on naftalan.health, providing at minimum:

  • Full name (as per passport or identity document);

  • Date of birth;

  • Nationality and passport/ID number;

  • Contact email address and phone number;

  • Preferred travel dates and health background relevant to Naftalan therapy.

By completing the booking form and proceeding to payment, the User confirms they have read, understood, and accepted this Agreement, the medical disclaimer in Section 8, and the refund policy in Section 5.

4.2. Payment of the Service Fee

The Naftalan Health Navigator service fee is €150 (one hundred and fifty euros), payable in full at the time of booking via one of the following methods:

  • Stripe: credit or debit card (Visa, Mastercard). The User is redirected to Stripe's secure payment page. Alexandr Umanet does not store card data. Privacy policy: stripe.com/privacy.

  • PayPal: payment via PayPal account or PayPal guest checkout. Privacy policy: paypal.com/webapps/mpp/ua/privacy-full.

All transactions are processed in EUR. A payment confirmation is sent automatically to the User's email address upon successful payment.

4.3. Service Confirmation and Delivery

Following confirmed payment, the Operator will contact the Client within 24 hours (on working days) to schedule the personalised medical orientation consultation and coordinate all subsequent steps.

A Service Agreement detailing the agreed scope, sanatorium recommendation, and deliverables will be sent to the Client by email. The service is considered formally engaged upon the Client's receipt of this Agreement.

The full scope of coordination services described in Section 3 is delivered progressively in the period between booking confirmation and the Client's return from the sanatorium.

5. Refund Policy

The €150 service fee is generally non-refundable prior to or during the trip, as the Operator begins work immediately upon payment confirmation.

However, the Operator offers a post-trip satisfaction guarantee covering the quality of coordination services and the sanatorium recommendation. If the Client is not satisfied with:

  • The quality of coordination services delivered by the Operator (consultation, flight optimisation, visa assistance, support, excursion); or

  • The sanatorium recommended by the Operator,

the Client may request a full refund of the €150 fee, subject to the following conditions:

  • The refund request must be submitted within 7 (seven) calendar days of the Client's return from the sanatorium;

  • The request must be submitted in writing to info@naftalan.health, stating the reason for dissatisfaction;

  • The refund is processed automatically upon receipt of the written request — no further review or approval is required;

  • Refunds are issued to the original payment method (Stripe or PayPal) within 5–10 business days.

This satisfaction guarantee does not extend to: sanatorium medical outcomes, treatment results, third-party service quality (flights, transfers, insurance), force majeure events, or circumstances beyond the Operator's control.

EU Consumer Rights Directive (2011/83/EU): As a consumer in the EU/EEA, you may also have the right to withdraw from a distance contract within 14 days of conclusion, unless the service has already been fully performed with your prior express consent. By proceeding to payment, you acknowledge that the Operator begins performance immediately and you expressly consent to this. Your post-trip satisfaction refund right above is additional to, and does not limit, any statutory rights you may hold.

6. Partner Conditions — Sanatoriums and Carriers

The terms and conditions of the Operator's partners — sanatoriums in Naftalan, Azerbaijan, airlines, and transfer operators — apply in addition to this Agreement. Alexandr Umanet acts exclusively as an independent coordinator and does not act as a direct provider of medical, accommodation, or transport services.

Partner conditions may include provisions regarding payment procedures, cancellation, modification of reservations, or specific restrictions. Some airlines may charge additional fees for baggage or flight changes. The Operator is not responsible for transfer fees between airports or terminals, nor for charges collected locally by sanatoriums or hotels.

Cancellation and refund conditions for sanatorium stays and flights are governed by the respective partner's policies and are communicated to the Client during the coordination process. These are separate from and independent of the €150 service fee refund policy in Section 5.

7. Intellectual Property

All materials available on naftalan.health — including texts, images, graphics, interface design, source code, brand identity, and research content — are protected by copyright and are the property of or licensed to Alexandr Umanet. All rights reserved.

Copying, decompiling, distributing, or creating derivative works based on the content or services of the platform without prior written consent of the Operator is prohibited. Users are granted a limited, non-transferable licence to view, download, and print materials from the platform exclusively for personal, non-commercial use, provided any copy retains the Operator's copyright notice. This licence may be revoked at any time.

8. Medical Disclaimer and Contraindications

Naftalan oil therapy treatments offered at sanatoriums in Naftalan, Azerbaijan — including naphthalan oil baths, paraffin treatments, and physiotherapy — are of a specific medical nature and may be contraindicated for certain categories of persons.

A list of known contraindications is available at: naftalan.health/therapy. By proceeding to payment and engaging the Operator's services, the User confirms they have reviewed the contraindications and understands the medical nature of the treatments.

Alexandr Umanet is not a medical professional and does not provide medical advice. The orientation consultation provided as part of the service is informational in nature — it is based on publicly available medical literature and over a decade of practical experience accompanying clients to Naftalan, and does not constitute a medical diagnosis or prescription.

The Operator bears no liability for adverse reactions, complications, or health consequences resulting from treatments undergone at the sanatorium, including in cases where the Client did not seek independent medical advice prior to travel.

The User is strongly advised to consult their general practitioner or a specialist before undertaking balneological treatment, and to inform the sanatorium's on-site physician of all existing conditions, medications, and prior medical interventions.

9. Limitation of Liability

While the Operator makes every effort to ensure high-quality coordination services, Alexandr Umanet does not guarantee that any destination or sanatorium is entirely free of risk. By engaging the Operator's services, the Client acknowledges that the Operator is not responsible for:

  • Events beyond the Operator's control, including force majeure, natural disasters, political instability, or travel restrictions;

  • The quality, safety, or medical outcomes of treatments provided by the sanatorium;

  • Flight delays, cancellations, or changes made by airlines;

  • Loss, theft, or damage to personal belongings during the trip;

  • Inaccuracies in information provided by the Client at the time of booking.

The Operator's total liability to the Client in connection with the services provided shall not exceed the amount of the service fee paid (€150), except in cases of gross negligence or wilful misconduct by the Operator.

10. User Declarations

By using naftalan.health and proceeding to payment, the User declares and warrants that:

  • They are at least 18 years of age and have full legal capacity to enter into this Agreement;

  • All information provided on the platform is truthful, complete, and current;

  • They are financially responsible for all purchases made through their account;

  • They have reviewed the contraindications for Naftalan balneological treatment listed at naftalan.health/therapy and, where necessary, have consulted a physician prior to booking;

  • They understand that the Operator acts as an independent coordinator and not as a medical provider, travel agency, or tour operator.

11. Conditions of Use and Prohibited Conduct

As a condition of using naftalan.health, the User undertakes not to use the platform for illegal purposes or in breach of this Agreement. The Operator provides platform services exclusively for personal, non-commercial use.

The following are prohibited:

  • Uploading, posting, or transmitting unlawful, harmful, abusive, defamatory, or indecent content;

  • Impersonating any individual or organisation, including the Operator or partner sanatoriums;

  • Sending unsolicited messages (spam) or unauthorised promotional materials;

  • Uploading files containing viruses, malware, or any code designed to harm the platform;

  • Disrupting or interfering with the operation of the platform, its servers, or connected networks;

  • Using automated processes or bots to access the platform for any purpose;

  • Using the platform for fraudulent or deceptive activities.

The Operator reserves the right to suspend or terminate access for any User who breaches these conditions, without prior notice and without liability to the User or any third party.

12. Modification and Interruption of Service

Alexandr Umanet reserves the right, at any time and without prior notice, to modify, temporarily suspend, or permanently discontinue naftalan.health or any part of its services. The Operator shall not be liable to Users or third parties for any such modification, suspension, or interruption, except where this directly affects a paid service already in progress, in which case the refund policy in Section 5 applies.

13. Links to Third-Party Websites

naftalan.health may contain hyperlinks to third-party websites (airlines, sanatoriums, insurance providers, authorities, etc.), provided for informational purposes only. Alexandr Umanet does not control these sites and is not responsible for their content, accuracy, or use. The presence of a hyperlink does not imply the Operator's endorsement of or association with the linked site or organisation.

14. Indemnification

The User agrees to indemnify, defend, and hold harmless Alexandr Umanet from any claims, legal actions, penalties, damages, or expenses (including reasonable legal fees) arising from:

  • The User's use of naftalan.health, or use by a third party accessing the platform with the User's credentials;

  • Content submitted or published by the User on the platform;

  • Breach of this Agreement or of third-party rights by the User.

15. Governing Law and Dispute Resolution

This Agreement and any disputes arising from it or from the use of naftalan.health are governed by the applicable law of the European Union, including the EU Consumer Rights Directive (2011/83/EU), the General Data Protection Regulation (GDPR), and, where applicable, the national law of the EU Member State of the User's habitual residence.

For Users resident in Israel, this Agreement is additionally subject to the Israeli Consumer Protection Law, 5741-1981. For Users resident in Turkey, the Turkish Law on Consumer Protection No. 6502 applies to the extent required by mandatory local law.

Any dispute will first be pursued through amicable resolution by written communication to info@naftalan.health. If no resolution is reached within 30 calendar days, EU-resident consumers may refer the dispute to the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr. Nothing in this Agreement limits the User's rights to seek redress through competent courts or statutory consumer protection bodies in their country of residence.
